Limited
Warranty for USA, Canada and Mexico
The limited warranty set forth below is given by RAU
Manufacturing Company LLC in the USA, Canada or Mexico with respect to the RAU
brand IM2000 Animal Immobilizer, MP2000 Mini Probe and EJ2000 Ejaculator
Probe (covered products) when the covered products are purchased and used in
the United States, Canada or Mexico. The
covered products (excluding battery) when delivered to the original purchaser are warranted against
defects in materials or workmanship for a period of (3) three years from the
original date of purchase. Defective products returned to RAU Manufacturing Company LLC,
or its authorized distributor, and proven to be defective upon inspection, will
be repaired with new or comparable rebuilt parts or exchanged for a refurbished
similar item as determined by RAU Manufacturing Company LLC. The
limited warranty covers all defects encountered in normal use of the covered
products and does not apply in the following cases: a)
Loss or
damage due to fair wear and tear, abuse, mishandling, improper packaging by you, alteration,
accident, electrical current fluctuations, failure to follow operating and
preventive maintenance procedures as outlined in covered products owners manual
and operating instructions accompanying covered products at time of sale, repair
or services performed by someone other than RAU Manufacturing Company LLC or an
authorized RAU Manufacturing Company LLC Service Provider. Without limiting the
foregoing, water damage, sand/corrosion damage, battery leakage, dropping the
product, scratches and abrasions will be presumed to have resulted from misuse,
abuse, or failure to operate the products as set forth in the operating
instructions. b)
Use of
parts or supplies other than those supplied and fitted by RAU Manufacturing
Company LLC that cause the covered products to function incorrectly. c)
If the
covered product has had its serial number altered or removed. NO IMPLIED WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE, APPLIES TO THE RAU BRAND IM2000 ANIMAL
IMMOBILIZER, MP2000 MINI PROBE AND EJ2000 EJACULATOR PROBE AFTER THE APPLICABLE
PERIOD OF THE EXPRESS WARRANTY STATED ABOVE GIVEN BY ANY PERSON OR ENTITY WITH
RESPECT TO THE RAU BRAND IM2000 ANIMAL IMMOBILIZER, MP2000 MINI PROBE AND EJ2000
EJACULATOR PROBE SHALL BIND RAU MANUFACTURING COMPANY LLC. RAU MANUFACTURING
COMPANY LLC SHALL NOT BE LIABLE FOR LOSS OF REVENUES OR PROFITS, INCONVENIENCE,
EXPENSE FOR SUBSTITUTE EQUIPMENT OR SERVICES, STORAGE CHARGES OR ANY OTHER
SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE OR MISUSE OF, OR
INABILITY TO USE REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND
EVEN IF RAU MANUFACTURING COMPANY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. IN NO EVENT SHALL RECOVERY OF ANY KIND AGAINST RAU MANUFACTURING
COMPANY LLC BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE RAU BRAND IM2000
ANIMAL IMMOBILIZER, MP2000 MINI PROBE AND EJ2000 EJACULATOR PROBE SOLD BY RAU
MANUFACTURING COMPANY LLC AND CAUSING THE ALLEGED DAMAGE. WITHOUT LIMITING THE
FOREGOING YOU ASSUME ALL RISK OR LIABILITY FOR LOSS OR INJURY TO YOU AND YOUR
PROPERTY AND TO OTHERS AND THEIR PROPERTY ARISING OUT OF MISUSE OF, OR INABILITY
TO USE THE RAU BRAND IM2000 ANIMAL IMMOBILIZER, MP2000 MINI PROBE AND EJ2000
EJACULATOR PROBE NOT CAUSED DIRECTLY BY RAU MANUFACTURING COMPANY LLC. THIS
LIMITED WARRANTY SHALL NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER OF
THE RAU BRAND IM2000 ANIMAL IMMOBILIZER, MP2000 MINI PROBE AND EJ2000 EJACULATOR
PROBE OR THE PERSON FOR WHOM IT WAS PURCHASED AS A GIFT AND STATES YOUR
EXCLUSIVE REMEDY. oooOOOooo
